Direct Sales and Account Service Terms

These Terms govern the accounts, direct-sale product pages, purchase entitlements, downloads, device management, license validation, and customer support services (the “Account Services”) operated by LUCAMOTIVE (“LUCAMOTIVE,” “we,” or “us”).

For transactions completed through Paddle Checkout, Paddle is the payment seller and Merchant of Record. LUCAMOTIVE is the software licensor and product-support provider. Paddle’s buyer terms and refund policy apply to the payment transaction, while these Terms and the applicable Product EULA apply to the Account Services and software license.

1. Business information and acceptance

You accept these Terms by creating an account, accepting them through a presented consent flow, or acquiring, downloading, or activating a direct-sale Product. You can review and save these Terms, the Privacy Policy, Refund Policy, and Product EULA before checkout. Do not use the Account Services or a direct-sale Product if you do not agree.

2. Eligibility and accounts

  1. You must have legal capacity to contract where you live. A child under 14 may not create an account without legally valid parental consent.
  2. Accounts are created and authenticated through Google sign-in or a one-time email code. LUCAMOTIVE does not collect a separate account password.
  3. You must use an accurate email account under your control and keep your email, devices, and Google account secure.
  4. You must not create multiple accounts to evade license limits, refund rules, or technical protections.
  5. Google and email sign-in accounts may be linked only after ownership of both sign-in methods is verified. We may decline to merge accounts merely because they present the same email address.
  6. If you suspect unauthorized access, terminate active sessions and contact support@lucamotive.com.

3. Product information and orders

  1. Current direct-sale Products, features, compatibility, price, currency, delivery method, and conditions are listed on the following Product page: https://lucamotive.com/en/products/super-pad/.
  2. Before checkout, you must review the Product name, supported Adobe Premiere Pro and operating-system versions, license conditions, delivered files, and known limitations.
  3. Paddle Checkout displays the final price and tax based on buyer location, currency, and payment method. If an estimated website price differs from the final checkout price, the price shown immediately before the order is submitted controls the payment transaction.
  4. You must sign in to a LUCAMOTIVE account before purchase. Our server links the internal user ID to the transaction. If a different billing email is used, the server-side transaction link confirmed by a signed Paddle event controls entitlement assignment.
  5. Paddle authorizes the purchase contract and payment and provides the order confirmation and receipt. Paddle or LUCAMOTIVE may reject or cancel an order for failed authorization, suspected fraud, legal or sanctions compliance, or an obvious pricing error.

4. Delivery and entitlement

  1. We grant the entitlement to your account after payment is completed and we successfully process Paddle’s signed transaction-completion notice.
  2. A browser success screen alone does not establish entitlement. If processing is delayed, do not repeat the same payment; contact support with your order email.
  3. You may download installers and manage activated devices through the Account page. A protected download link may expire after a short period.
  4. If delivery technically fails or is unreasonably delayed, we will assist with redelivery. If it cannot be resolved, any refund right under Paddle’s procedures and applicable law remains available.

5. Key license conditions

The Direct Edition EULA contains the complete software license. Unless a Product page expressly states otherwise, the initial policy is:

  1. a one-time purchase grants a non-exclusive, non-transferable license to one individual user;
  2. that user may activate the Product on up to two devices under that user’s control; two people may not share one entitlement;
  3. the Product may operate offline for up to 24 hours after the latest successful online validation for both personal and organization licenses, with checks at startup and every four hours while running; already issued offline licenses may retain their previous expiry until the next successful validation;
  4. the acquired major version may be used perpetually. A major version is identified by the first numeric component of the Product version. For example, a 1.x license includes updates that LUCAMOTIVE releases within 1.x, while 2.x may be offered as a separate Product or paid upgrade;
  5. devices may be deactivated in the Account page; abnormal repeated deactivation and activation may be temporarily limited while suspected sharing is reviewed; and
  6. direct-sale entitlements are not automatically combined with Adobe Marketplace or aescripts purchases. Cross-channel transfers or exchanges exist only if expressly offered.

6. Your responsibilities and prohibited conduct

You must not:

  • share, sell, rent, transfer, disclose, or redistribute an account, verification code, installer, entitlement, or license;
  • bypass or tamper with device limits, validation, protected downloads, or other technical measures;
  • reverse engineer, attack, or automate access to the Product or Services beyond what applicable law expressly permits;
  • interfere with the Services through malware, excessive automated requests, false refunds, fraudulent payments, or impersonation;
  • infringe intellectual-property, privacy, or other rights, or use the Services for unlawful content; or
  • publicly exploit a vulnerability without first allowing a reasonable opportunity for private reporting and remediation.

7. Updates, compatibility, and support

  1. We use reasonable efforts to make the Product materially conform to its description in the supported environment listed on the Product page.
  2. Changes to Adobe Premiere Pro, operating systems, or third-party APIs may affect compatibility. Operation outside the supported environment is not promised.
  3. Back up important projects and media before using features that modify a project.
  4. Support is available at support@lucamotive.com and the official support pages. Unless separately agreed, no particular response time or resolution of every issue is guaranteed.

8. Payments, refunds, and chargebacks

  1. Paddle is the payment seller and Merchant of Record and handles payment methods, tax, receipts, refunds, and payment disputes. We do not separately invoice a buyer for a Paddle transaction or send a refund directly to the buyer.
  2. You may request a refund within 14 days of the transaction date. Refunds are governed by the LUCAMOTIVE Refund Policy, Paddle Refund Policy, and mandatory consumer law. A request can be submitted using the Request refund button at the bottom of order details after selecting the product in your LUCAMOTIVE account’s Billing history, the Paddle receipt, buyer portal, or Paddle buyer support.
  3. When a full refund, reversal, or chargeback cancels a transaction, the associated entitlement, downloads, and next license validation end. You must stop using the Product and must not distribute any installer in your possession. Approved partial refunds alone do not revoke the full entitlement until their total reaches the amount paid.
  4. Account deletion is not a refund request. Refunds must be requested separately.

9. Restriction and termination

  1. Account settings: https://lucamotive.com/en/account/#/settings. You can close your account directly in account settings after verifying your identity. Confirmation ends all web sessions and stops online validation, downloads and device connections. Previously issued offline access may remain until its allowance expires. With your separate agreement, we keep account information for 30 days from closure to allow recovery. Before the deadline, sign in and explicitly choose Restore account to resume use. Signing in alone does not cancel closure. Recovery becomes unavailable after the deadline. An hourly automatic job deletes account, authentication, license, device and unnecessary operational records. Failed jobs are retried and operators intervene when needed. A new account does not automatically restore previous licenses. Closure does not cancel purchases or request a refund and does not limit statutory consumer rights.
  2. We may temporarily limit an account or feature to the extent reasonably necessary for a security risk, suspected fraud or unauthorized sharing, legal or sanctions compliance, or a material breach.
  3. We give reasonable notice and a cure opportunity for a remediable breach. We may act without advance notice for unauthorized redistribution, validation circumvention, payment fraud, or an immediate security risk.
  4. You may appeal a restriction through support@lucamotive.com.

10. Service changes and discontinuation

  1. We may change parts of the Account Services for security, legal compliance, maintenance, or product improvement. We will not retroactively reduce the essential rights of a completed purchase without a reasonable legal basis.
  2. Where practicable, we notify users of planned maintenance or a material outage. The 24-hour offline period reduces the effect of a temporary validation outage; first activation, device changes, and revalidation after 24 hours require an internet connection.
  3. If the validation service is permanently discontinued, subject to applicable law and technical feasibility, we will give reasonable advance notice and provide an available means of continued use, such as a final build that removes or reduces reliance on online validation, an alternative validation method, or a substantially similar measure. The discontinuation notice will describe the specific method and schedule.

11. Intellectual property

The Account Services, Products, documentation, marks, and software are owned by LUCAMOTIVE or the applicable rights holder. A purchase grants a license under the EULA and does not transfer ownership. Rights in lawful final outputs such as your videos remain with you or the applicable rights holder.

12. Warranties, liability, and statutory rights

  1. We use reasonable efforts to make a Product materially conform to its description and documentation.
  2. To the maximum extent permitted by law, the Services and Products are provided “as is” and “as available,” without a promise of suitability for every purpose, uninterrupted or error-free operation, or compatibility with every future environment.
  3. To the maximum extent permitted by law, we are not liable for unforeseeable indirect, special, or consequential losses or loss of business, revenue, profit, or data. Our aggregate liability relating to a Product will not exceed the amount you actually paid for that Product.
  4. Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury, statutory guarantees, mandatory consumer rights, or any liability that cannot lawfully be excluded or limited.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Korea. If you are a consumer, mandatory consumer-protection laws and non-waivable jurisdiction rights in your country or region continue to apply. The parties will first try in good faith to resolve a dispute through support@lucamotive.com. If unresolved, either party may use a court or dispute-resolution process available under applicable law.

14. Changes

We may revise these Terms for changes in law, the sales model, or the Services. We give advance website or account-email notice of material changes. We will not retroactively reduce essential rights attached to a completed purchase without consent or another lawful basis. Mandatory local law and language-display requirements prevail over any conflicting translation provision.

Organization purchases require at least five seats per product initially, with a 10% discount on the personal unit price, rounded to currency cents before multiplying by quantity. An organization with an eligible paid initial purchase may add one or more seats for that product. The purchaser becomes the owner without an automatic seat assignment. Invitations reserve seats, and acceptance by the verified recipient account assigns the license. A completed full-order refund revokes that order’s seats and invitations.
